The EB-5 Immigrant Investor Visa

A direct path to US Permanent Residency for Kuwaiti families.

The EB-5 program provides a US Green Card (Permanent Residency) to foreign investors, their spouses, and unmarried children under 21, in exchange for a qualifying job-creating investment in the United States.

Investment Requirements (Post-RIA 2022)

Location Minimum Capital Job Creation Reqt.
Targeted Employment Area (TEA)
Rural or High Unemployment area.
$800,000 10 US Jobs
Standard (Non-TEA) $1,050,000 10 US Jobs

The Regional Center Advantage

Over 95% of EB-5 investors utilize a Regional Center rather than a Direct Investment. Why?

  • Indirect Job Creation: Regional Centers can count indirect and induced jobs (e.g., construction spend) toward the 10-job requirement, significantly lowering immigration risk.
  • Passive Investment: The investor acts as a Limited Partner, while professional developers manage the project.

The Rural Priority Route

The EB-5 Reform and Integrity Act (RIA) of 2022 created a powerful incentive: Rural TEA projects now receive priority processing. For Kuwaiti investors (who do not face country-specific backlogs like China or India), selecting a Rural project can reduce the I-526E petition processing time from 4+ years to under 18 months.

The Capital Stack & Risk

An EB-5 investment is typically deployed as mezzanine debt or preferred equity in a large-scale real estate development (e.g., a luxury hotel or residential tower). The primary goal of an EB-5 investment is the preservation of capital and the successful acquisition of the Green Card, not high yield. Typical returns range from 1% to 5% annually.
